§ 1 Scope and Authorized Jurisdictions
(1) These Terms and Conditions apply to all contracts regarding the purchase of virtual currency (“Spicycoins”) and the use of digital content (video files, streams, art) between EP STUDIOS UG (haftungsbeschränkt) (hereinafter “Provider”) and the customer (hereinafter “Customer”).
(2) Strict Geographic Limitation (Whitelist): Experiences and content on this website are exclusively directed at and available to customers with a habitual residence and IP address located in the following Authorized Jurisdictions:
- North America: United States of America, Canada
- Europe (Non-Restricted): United Kingdom, Switzerland, Norway, Iceland, Liechtenstein, Netherlands, Sweden, Denmark, Finland
- Asia-Pacific: Australia, New Zealand, Japan, Taiwan
- Latin America: Brazil, Mexico
The Provider reserves the right to update this list at any time. Any access or attempted purchase from outside these Authorized Jurisdictions (specifically including, but not limited to, Germany, France, and mainland China) is strictly prohibited.
§ 2 Nature of Content & Fictional Characters
(1) 100% Fictional Content: The Customer acknowledges that all content consists entirely of artistic, computer-generated, animated, or drawn depictions. No real human beings are depicted.
(2) Age Representation: All fictional characters depicted in sexual situations are designed to definitively represent individuals 18 years of age or older.
(3) Fantasy Disclaimer: Any resemblance to real persons is purely coincidental. The content is a work of fiction and fantasy intended for adult entertainment only.
§ 3 Virtual Currency (“Spicycoins”)
(1) Nature of Coins: The Provider offers virtual currency (hereinafter “Spicycoins”) for purchase. Spicycoins act as a license right to access specific digital content within the shop. They are not a financial instrument, cryptocurrency, or real money and have no monetary value outside of this specific website.
(2) Scope of Use: Spicycoins can solely be explicitly exchanged for the streaming or downloading of digital content offered on this website. A payout of the coin balance in real money (Euros/Dollars) is excluded.
(3) Non-Transferability: Spicycoins are tied to the Customer’s user account and cannot be transferred to other users or third parties.
(4) Refund and Exchange Policy: Spicycoins are non-refundable and cannot be exchanged back into fiat currency (e.g., EUR, USD). They are intended solely for use on this website. Once a Spicycoin package is purchased and credited, or partially used, the entire transaction is considered final and cannot be refunded.
§ 4 Age Requirement & User Warranties
(1) The content provided is strictly for adults. The Customer warrants that they are at least 18 years of age (or the age of majority in their jurisdiction).
(2) By entering the site and initiating a purchase, the Customer legally declares under penalty of perjury that they are an adult within an Authorized Jurisdiction.
§ 5 Conclusion of Contract
(1) The presentation of Coin Packs in the web shop implies an invitation to place an order.
(2) By clicking the “Buy Now” or “Place Order” button, the Customer places a binding order for the selected amount of Spicycoins.
(3) The contract is concluded when the Provider accepts the order by crediting the purchased Spicycoins to the Customer’s account balance immediately after payment confirmation.
§ 5a Payment Information (Merchant Descriptor)
To help you identify this transaction on your bank statement:
Credit card charges will appear on your statement as “SPICYCOMIC” or “EP STUDIOS”.
§ 6 Right of Withdrawal and Express Waiver for Virtual Currency (Spicycoins)
(1) Statutory Right of Withdrawal: For consumers within the European Union, a statutory right of withdrawal of 14 days generally applies to the purchase of digital goods.
(2) EXPRESS WAIVER AND AGREEMENT: The Customer hereby expressly consents to the Provider beginning with the performance of the contract before the withdrawal period has expired. The performance of the contract consists of the immediate crediting of the purchased Spicycoins to the Customer’s user account, making them available for immediate use.
(3) Premature Expiry of the Right of Withdrawal: The Customer acknowledges and agrees that by giving this express consent, they lose their statutory right of withdrawal as soon as the performance of the contract (i.e., the crediting of Spicycoins) has been fully completed. This consent must be actively confirmed via a mandatory checkbox during the checkout process before completing the purchase.
§ 7 Refund Policy for Technical Failures
(1) While the general Right of Withdrawal is excluded for successfully delivered digital goods (see § 6), the Provider guarantees the technical delivery of the purchased license.
(2) Dispute Resolution: If technical problems prevent or unreasonably delay the delivery of purchased Spicycoins or the unlocking of content, the Customer may request a refund. Refunds are granted at the sole discretion of the Provider upon verification of the technical error and are typically processed within 14 business days.

§ 8 Content License
(1) By exchanging Spicycoins for a specific video or artwork, the Provider grants the Customer a non-exclusive, non-transferable license to use this content for private, non-commercial purposes only.
(2) Prohibitions: Uploading to file-sharing sites, reselling, public screening, or using the content for AI training is strictly forbidden.
§ 9 Prohibition of Circumvention (VPN Policy)
(1) Zero Tolerance: Using software (VPN, Proxy) to disguise the location and access the service from a restricted jurisdiction (e.g., Germany) is a material breach of contract.
(2) Consequences: The Provider reserves the right to terminate the Customer’s account immediately without refund of any remaining Coin balance if this policy is violated.
§ 10 Liability
(1) The Provider is liable for intent and gross negligence. Further liability is excluded to the extent permitted by law.
(2) The Provider assumes no liability for technical issues on the Customer’s end (e.g., slow internet connection or incompatible hardware).
§ 11 Governing Law
(1) These Terms shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) Consumer Protection Note: This choice of law does not deprive the consumer of mandatory protection laws of their habitual residence (applies only to consumers within Authorized Jurisdictions).
